A judgment debtor must indeed pay the debt according to the law, but the courts have little authority to compel payment. That’s why it’s important to know how to collect on a judgment if your debtor fails to pay you.

What happens once a judgment is made?

Once a judgment is issued, the winner of the court case becomes the judgment creditor and the loser becomes the judgment debtor. After the court has issued its judgment, the court clerk sends a written decision to all involved parties. This decision specifies how much the judgment debtor owes the judgment creditor. If you’ve sued more than one individual, the court’s decision will list the total amount that all parties owe you. These parties must then divide the responsibility for payment among themselves.

A judgment is not always official immediately upon being issued by a court. That’s because the judgment debtor has 30 days (or less, in some states or municipalities) to file an appeal. How to collect on a judgment

To collect on a judgment, take the following steps:

1. Perfect a real estate lien.

Regardless of whether your judgment debtor files an appeal, you should prepare for the worst — namely, your debtor attempting to hide their assets and thus making collecting your judgment more difficult. You can plan for this possible outcome by perfecting a real estate lien.

To perfect a real estate lien, you must record your judgment with the county recorder’s office. With a lien in place, your debtor must fulfill the judgment before they can sell their building or property. Additionally, a real estate lien may remain valid if the debtor files for bankruptcy.

2. Reach out directly.

Sometimes, you won’t need to seize property. You might find that reaching out to the debtor to request payment after a court judgment is enough to compel the payment you’ve long sought. Don’t threaten the debtor or detail how you plan to collect the judgment if you don’t receive it in a timely fashion, but remain firm that the debtor now legally owes you money.

3. Choose the right assets to seize.

Wage garnishment, business cash or asset seizure are all valid ways to collect the money your debtor owes you. However, consider the following points as you do so:

Wage garnishment is easy but slow. It’s often straightforward to obtain a writ of garnishment requiring that part of your debtor’s wages be garnished and given to you. However, garnishments are usually capped at 25 percent of the debtor’s wages, making full repayment of your debt a slow process. Additionally, some low-income debtors may be exempt from garnishment, and government benefits payments cannot be garnished.

Business asset seizure requires enforcement. Only law enforcement authorities can seize cash, money stored in business bank accounts or other assets. Additionally, they may charge a fee for their services. However, if your debtor’s assets are valuable enough to cover their debts, seizing these assets may be worthwhile.

Personal asset seizure is even more complicated. If you’re going after a debtor’s personal property, they likely have equity, which is the difference between an item’s current value and its loan value. Many states forbid judgment creditors from seizing a certain amount of equity from debtors. These rules mean that homes, vehicles, investment accounts, electronics and jewelry can be tough to seize.

Occasionally, you can file judgments with licensing boards. If the judgment debtor is a remodeling or building contractor, you may be able to file your judgment with the relevant state licensing board. In doing so, your debtor could lose their license if they do not comply with the judgment. However, this route is viable only in extremely specific circumstances.

Given the above considerations, you’ll need to weigh the ease of collection against the urgency of the debt repayment. Should you pursue wage garnishment but wait far longer to collect your full debt? Are you willing to work with sheriffs or marshals for business asset collection? Is the potentially large value stored in your debtor’s personal assets worth the work to obtain the amount you’re owed?

4. Renew your judgment.

As mentioned above, judgments aren’t permanent. However, they are renewable — a feature that can help with debts that take years to collect (which aren’t unheard of). A renewed judgment is often valid for as long as the original judgment was valid, starting from the date of renewal. Each state’s court system handles judgment renewals differently, so speak with a debt collection lawyer about how to go about this process.

5. File a satisfaction-of-judgment notice.

After the debts are paid, the judgment creditor submits a “satisfaction of judgment” notice to the court. This notice informs the court that it can close the case. Similarly, if you perfected a lien on the debtor, you would file paperwork with the aforementioned recorder’s office.

6. Hire a collection agency.

Using a collection agency is often viewed as a measure to be taken after standard communications with a nonpaying client have failed but before a lawsuit is filed. Some collection agencies, however, specialize in collecting debts from debtors who defy judgments.

There are freelance creditors, too. However, for small business debt collection, agencies may be too expensive to merit their work, given what they are likely to recoup. Some agencies may take up to half of the debt they collect as their payment, though others may take closer to 25 percent. In either case, you’ll pay quite a bit.

Judgment debtors and assets

Shortly after a judgment is issued, the debtor must file a financial disclosure statement. In this statement, the debtor lists all of their assets. If they fail to complete this step, a contempt-of-court charge can be issued.

Alternatively, a judge can demand the debtor to appear in court for a debtor’s examination. Judgment creditors should attend this examination, and the debtor should disclose all of their assets in each of these categories:

Cash

Checking and savings accounts

Investment accounts

Business ownership shares

Trusts and inheritances

Safes, vaults and other secure storage spaces

Real estate

Personal property, including homes, vehicles and jewelry

Property transfers, as properties transferred for prices below their fair market value may indicate fraud intended to circumvent debt

If a judgment debtor doesn’t appear for an ordered examination, the judge may issue an arrest warrant.

Which judgment debtor assets should you pursue?

In an ideal world, a judgment against a debtor would immediately compel the debtor to repay their financial obligation to you in cash. However, some debtors may still resist payment. In this case, you may be able to seize certain assets by doing the following:

Garnishing the debtor’s wages

Taking cash or assets directly from businesses the debtor owns

Seizing real estate or vehicles

Often, the first two approaches are easier than the third one.

How long does it take to enforce a judgment?

Judgments are valid for different periods of time, depending on the state in which the lawsuit was filed. For example, Pennsylvania has an enforcement period of five years, while approximately a dozen states allow enforcement for up to 20 years. Consult the applicable state court, or speak with a lawyer to determine how long you have to enforce the judgment.

However, as mentioned earlier, a judgment is not, in and of itself, enforceable. If the judgment debtor still refuses to pay, only certain authorities can move forward with enforcement.

Learning to ride a bike is a rite of passage in many families and communities, and that means the ability to teach someone how to ride a bike is an equally important skill. The first few tries can be scary for kids, but finding the right balance, and coordination will be easier if they have a confident teacher guiding them. That’s where you come in. 

Now, it’s not entirely natural to perch atop a pair of wheels, and falling is a near-certainty until a child has found their bike legs. Challenges are part of the process, but there are a number of ways that you can help the kid you’re teaching get comfortable on two wheels with limited trouble.

Ditch the training wheels—balance bikes are best

If you’re in your 20s or older, you probably remember learning to ride a bike with clunky training wheels bolted to the back wheel. These two extra wheels got us up on the bike and learning how to pedal. But they do a terrible job teaching the hardest and most important part of riding a bike, which is balance, according to Phil Yip, a certified cycling instructor with the League of American Bicyclists who teaches with Bike East Bay and the San Francisco Bicycle Coalition. The far superior alternative, he says, is to start on a balance bike. 

Balance bikes are simple. They’re just like small regular bikes, except without pedals. Riders propel themselves forward by pushing with their feet on the ground, essentially running with the bike beneath them. New riders can walk as slow as they want while seated on the bike, and as they get comfortable, start to move faster until they naturally lift their feet and glide farther and farther. Once they’ve mastered staying upright with their feet off the ground and can turn with a combination of the handlebars and leaning, it’s easy enough for them to hop up on a regular bike and learn the nuances of pedaling, starting, and stopping. There’s often no need for training wheels at all. One study found that children who started on a balance bike learned to ride a pedal bike around 4 years old on average, while those who started on a bike with training wheels didn’t learn until they were closer to 6.

I started my kids on balance bikes when they were about 2 (they’re twins), and in a couple of weeks they were zooming and gliding faster than I could keep up with on walks around our neighborhood. When we introduced pedal bikes a few months before their fifth birthday, they got the hang of riding in two short driveway practice sessions and could easily start on their own without a push a few days later. They used training wheels for a total of 30 minutes, and that was only because we bought the bikes fully assembled and they refused to wait for me to take them off before hopping on.   

Even if your kids are older, or you’re trying to teach yourself as an adult, balance bikes are a great way to start. If you can’t find a larger balance bike or don’t want to buy one, Yip suggests removing the pedals from a regular bike and lowering the seat so the rider’s feet rest flat on the ground.

Create a fun, safe space for learning

Riding can be scary at first, so it’s important that kids start off in a comfortable environment. “Start in a flat, traffic-free area, such as a park or a quiet cul-de-sac, where your child can practice without distractions or dangers,” says Peter Ballin, a former international mountain bike racer, UCI Mountain Bike World Cup mechanic, and bicycle coach out of Morzine, France. “Ideally, start them on grass so it’s softer if they fall.” They shouldn’t have to worry about navigating around dangers or running out of space. Let them focus solely on riding.

It’s also important to remember that learning new skills is uncomfortable, so don’t push kids too hard, Yip says. After all, riding a bike should be fun. If the kids aren’t enjoying it, or are getting stressed from too much pressure, they’re going to have a harder time learning. “It’s better to let the child learn at their own pace,” he says. There’s no set amount of time that it should take. In Yip’s classes, students sometimes move from a balance bike to a pedal bike in a single day, but others might take weeks or months to get comfortable with the transition—and that’s OK.  

Ballin adds that as your child improves, giving them little challenges can be a fun way to keep them engaged and pushing themselves without undue pressure. He recommends setting up simple obstacle courses for your kid to navigate, or racing against a clock to keep them motivated and excited to learn.

Don’t forget to teach safe riding habits, too

Teaching a kid to ride a bike isn’t only about guiding them through balance and pedaling. They also have to learn about safety. First is the importance of wearing a helmet anytime they’re out riding. One analysis found that wearing a helmet could reduce the risk of head injuries by 45 percent, brain injuries by 33 percent, facial injuries by 27 percent, and deaths by 29 percent. I’ve seen the value of a helmet in action—one of my kids took a pretty bad balance bike spill and landed on the road on his face. The rim of the helmet saved him from no more than a split lip. Without the helmet, I’m sure it would have been a trip to the hospital instead.

Helmets are most effective when they fit properly. The National Highway Traffic Safety Administration has a clear and detailed document on how to adjust a helmet to an adult’s or child’s head. Basically, you want the helmet level on the head, low on the forehead, the “V” of the straps tight under the ears, and the chin strap snug enough that only a finger or two can fit under it. If a helmet is too loose, or in the wrong position, it may not do its job.  

Learning in a group can help kids get over their fear

If your child is struggling, or too afraid to hop on the bike, getting more people involved might be helpful, Yip says. If they have a friend, neighbor, or relative who can already ride a bike, try to get them together so your child can mimic what they’re doing. Sometimes seeing someone close to their age doing a feared activity can be all the motivation a kid needs to try something new.  

Classes are another option. In addition to providing people for your child to watch, sometimes kids need to learn from someone other than a parent or caretaker, particularly if you find yourselves getting frustrated by a lack of progress. Classes can also be a validating experience for kids who might be embarrassed that they don’t know how to ride yet, Yip says. They’ll see people of all ages who are also learning to ride, and realize that there’s no shame in not having mastered the skill yet.

And once your child is up and running on their bike, so to speak, biking groups and classes are a great way to expand their, and your, knowledge about cycling. Whether it’s getting more comfortable with street riding and racing, diving into the exciting world of BMX, or heading up into the hills for some mountain biking, there are a ton of ways to expand their skills and keep them in the saddle.

To avoid this, encourage your team members to share when they disagree with a decision — whether it’s for a single project or for a larger initiative.

The larger the project or initiative, the more difficult it is to conclude it successfully based on a single perspective. You can likely make a salad on your own but you cannot build a spaceship.

Romanian organization, Bitdefender, via its Cyber Threat Intelligence Lab started research in November last year, that was dedicated to analyzing the potential threats of a newly discovered password-stealing malware operation. That malware had initially targeted Chinese businesses, however, it has recently spread wings and has now infected home systems and organizational networks. As per the report, the first thing to do should be killing the rundl32.exe process in the task manager. Besides this, thorough cleaning of browser history and cookies is also recommended. The report also suggests changing of account passwords and deletion of suspicious browser extensions is also a way to remove the injected code from the system.

Scranos is a new thing in malware trends and its rootkit-based nature is something not very common. Most of the malware attacks are based on malvertising and phishing, however, this seems to change the benchmark.
